REVIEW OF THE ARTICLE “ANY CHANCE FOR THE ENFORCEABILITY OF THE HUMAN RIGHT TO SUBSISTENCE?”
This review analyzes the content of the article «Any Chance for the Enforceability of the Human Right to Subsistence? « focusing on the economic, social, and cultural right to subsistence in general, and to food in particular, its constitutionalization, and social and political enforceability. The author raises the discussion about the inclusion of abstract social rights, especially the right to subsistence and, in particular, the right to food, in constitutions and laws, as well as the relevance of granting interpretive powers to judges in this type of rights, always with an incrementalist approach.The article identifies five main challenges in this process, with the social and political enforceability of the right to subsistence and food being the most relevant amidst a context where these rights have solid philosophical foundations but still have a long way to go to become enforceable, despite their significant role in achieving Sustainable Development Goal 2, «Zero Hunger.»
